KVKK Privacy Notice

In accordance with Article 10 of Law No. 6698 on the Protection of Personal Data ("KVKK") and the Notification on Procedures and Principles to be Followed in Fulfilling the Obligation to Provide Information, this document has been prepared to fulfill our obligation to inform you regarding the personal data processed by [İsrafil USLU on behalf of Evmar Property Real Estate Services] ("Evmar Property") in its capacity as data controller.

Depending on your status (Listing owner, buyer/tenant candidate, website visitor, consulting applicant), the following categories of your personal data may be processed:

Identity Information: Name, surname, Turkish ID number (if requested during contract/title deed processes)
Contact Information: Phone number, email address, address
Customer Transaction Information: Preferences regarding requested/offered properties, meeting notes, offer and negotiation process records
Financial Information: Budget range, intention to use credit and other transaction process-specific information (we do not collect bank account information)
Property Information: Address of the property in the Listing, title deed information, m², number of rooms and other technical information related to the listing
Transaction Security Information: IP address, cookie identifiers, browser/device information
Marketing Information: Website browsing behavior, campaign interaction data (subject to your explicit consent)

3. Purposes of Processing Personal Data

Your personal data is;

Provision of real estate purchase, sale, rental and consulting services and conducting of processes,
Matching your Listing or request with relevant parties,
Preparation and execution of contract processes (consulting agreement, preliminary protocol, etc.),
Maintenance of customer relationship management (eCRM) records,
Evaluation of requests and complaints,
Fulfillment of legal obligations,
Sending you commercial electronic communications and conducting marketing activities, subject to your explicit consent

purposes.

4. Method and Legal Basis of Personal Data Collection

Your personal data is collected through various channels such as meetings at our office or via the website, completed contact/request forms, phone calls, email and WhatsApp correspondence, using methods that are partially automated and partially non-automated.

This data is processed based on the following legal grounds set forth in Articles 5 and 6 of the KVKK:

Being directly related to the conclusion or performance of a contract (consulting/brokerage agreement),
Fulfillment of a legal obligation,
Legitimate interests of the data controller,
Your explicit consent (for marketing communications and non-essential cookies)

5. Parties to Whom Personal Data May Be Transferred

Your personal data may be transferred, limited to the processing purposes, to:

The counterparty in the purchase/sale/rental process (buyer, seller, tenant, lessor) to the necessary extent,
Official institutions such as title registry offices and notary offices as required by the process,
In case of your request to use credit, to the relevant bank or financial institution,
To suppliers from whom we receive hosting, CRM and marketing infrastructure services (server provider, Google Analytics/Tag Manager, CookieYes, Meta/Instagram advertising platforms),
To authorized public institutions and organizations (upon request)

may be transferred in accordance with the conditions specified in Articles 8 and 9 of the KVKK.

6. Rights of the Data Subject under Article 11 of the KVKK

As the relevant person, you have the following rights:

To learn whether your personal data is being processed,
To request information regarding it if it is being processed,
To learn the purpose of processing and whether it is being used in accordance with that purpose,
To know third parties to whom it has been transferred domestically/abroad,
To request correction if it has been processed incompletely or incorrectly,
To request its deletion or destruction within the scope of conditions stipulated in the KVKK,
To request that correction/deletion/destruction operations be notified to third parties to whom data has been transferred,
To object to a result being produced against you through processing data exclusively by automatic systems,
To request compensation for damages incurred as a result of unlawful processing.

7. Method of Application

To exercise the rights listed above, you may submit your request along with documents proving your identity via email to [info@evmar.com.tr] or in writing to [Kayabaşı Mah. Adnan Menderes Bulvarı Kuzey Yakası Ofisleri A3 Blok No.8 Başakşehir, Istanbul]. Your application will be concluded free of charge as soon as possible and within a maximum of 30 (thirty) days depending on its nature.

This Privacy Notice may be updated in line with changes that may occur in the legislation or our business processes. The current text is always published on this page.
